ATLANTA — Opening statements began Monday in a lawsuit filed by the owners of The Nook on Piedmont Park against the Piedmont Park Conservancy, as the popular Atlanta restaurant claims a sinkhole beneath its building has led to persistent safety concerns and financial hardships.
The lawsuit, filed in 2023, alleges that the Conservancy failed to properly investigate and repair a massive sinkhole discovered in 2018. Attorneys for The Nook argue that the Conservancy did not bring in a geotechnical engineer to assess the site, leaving “unresolved safety issues” that could pose a risk to the public.
The restaurant’s owners say the instability caused by the sinkhole has created ongoing problems for their business. They claim the Conservancy’s failure to conduct a thorough inspection has contributed to structural concerns and financial losses.
Attorneys representing the Piedmont Park Conservancy deny the allegations, arguing that the claims are baseless and that the restaurant owners failed to take appropriate steps to mitigate their financial situation. The Conservancy asserts that it acted in good faith in addressing the sinkhole issue.
The trial is expected to continue throughout the week as both sides present evidence and testimony.
