Phoenix woman gets $8,400 renovation deposit back after refund fight

PHOENIX (AZFamily) — Nancy Barnes was planning a bathroom renovation, and before she started the project, she called contractors for quotes.

She felt some sticker shock with the first quote.

“He gave me the high pressure, you know, if I leave now, I can’t guarantee this price,” Barnes said. “So I did the stupid thing and I gave him a deposit.”

Barnes signed a contract and gave Aloft Remodeling $8,400.

“Now that I think about it, it was really, really stupid because it was more than 50% of the total,” she said.

Cancellation and delays

Barnes slept on it and decided to cancel with Aloft Remodeling. She knew she had that right in her contract.

“I know I’m within my three-day rescission period, and I just want my deposit back. Easy peasy,” Barnes said. “They’re like, ‘well, there’s a form you have to fill out.’ Not a problem. I filled it out and sent them a professional letter.”

“That’s when the runaround started,” she added. “I got, ‘Oh, well, it’s going to be ten days to process,’” she said.

After ten days, she was told there was a mistake in the processing, and the company had to start over. Another ten days passed with no refund in sight.

According to the contract Barnes signed, the company actually had 30 business days to refund the money.

“I’m disabled. My husband is retired. We live on a fixed income. We’re not rich people,” Barnes said. “So $8,400 for me is a lot of money.”

After 30 business days had passed and Barnes still didn’t have her money, she reached out to On Your Side.

“As I’m often told, ‘you’re just too nice, so that’s why we’re here today,’” Barnes said. “Nancy’s not being nice anymore. I played fair. Why can’t they?”

Quick resolution

On Your Side contacted the company. Immediately, the team got results.

“I got my money back,” Barnes said. “What amazed me was all of a sudden, I get a message from the woman I had been trying to get a hold of for a couple of weeks.”

Barnes called her bank and confirmed the deposit.

“The next day, it was actually in my account and I was like, ‘oh, holy moly!’” she said.

The company never responded directly to On Your Side about the situation.
