NORMAL (25News Now) – Electric vehicle maker Rivian is demanding a refund on all Trump Administration tariffs found to be illegal by the U.S. Supreme Court, according to a lawsuit filed last week.
Rivian imports automotive products used to make EVs at its factory in Normal and is entitled to a refund in the “tens of millions of dollars,” a company executive said in late April.
Courts found tariffs invoked by the president under the International Emergency Economic Powers Act (IEEPA) were found by the courts to be unlawful. However, Rivian found it necessary to sue the government because refund amounts are not guaranteed.
The nine-page lawsuit was filed in the U.S. Court of International Trade.
Rivian is represented by attorneys from Chicago-based Page Fura, P.C., which specializes in international trade law.
The lawsuit does not specify the amount that Rivian believes should be refunded to the company. However, Rivian Chief Financial Officer Claire McDonough indicated during a first quarter earnings conference call on April 30 that the company is expecting a substantial refund.
“We do believe that the recovery of those IEEPA tariffs is possible in the future, and I can contextualize the sizing to be in the tens of millions of dollars of future benefit,” McDonough said.
The United States of America, U.S. Customs & Border Protection, and that agency’s commissioner, Rodney S. Scott, are all named as defendants in the lawsuit.
