Council denies Spoil to Soil’s appeal following a lengthy dispute over land-use requirements at its Browns Canyon operation
SUMMIT COUNTY, Utah — The Summit County Council voted Wednesday to uphold the revocation of two conditional use permits for Spoil to Soil, a Browns Canyon composting and recycling business in a long-running dispute with the county over land-use requirements.
The council denied an appeal of the Eastern Summit County Planning Commission’s decision to revoke permits for the Class II recycling facility and nursery and greenhouse at 7550 W. Lower Bowl Road. Kylee Mimbach operates the business on property owned by Troy Long Enterprises Inc.
TownLift previously reported that County staff maintained that multiple violations remained unresolved despite inspections and opportunities to correct them. Those included grading, road requirements, materials stored on the property, and other permit conditions.
During the council’s Sept. 2 hearing, attorney Kyle Reeder of Cannon Law Group, representing Mimbach, disputed several of the county’s allegations. He argued that the business had made good-faith efforts to correct violations and that some activities cited by county officials were allowed under its existing permits.
Reeder also maintained that certain grading work could not be completed after the county ordered work to stop.
At Wednesday’s meeting, council members voted without opposition to deny the appeal and uphold the planning commission’s decision. The motion cited evidence and testimony presented during council proceedings on Sept. 24 and Oct. 15, 2025, and Feb. 25 and Sept. 2, 2026.
The county’s chief deputy county attorney will prepare written findings of fact and conclusions of law documenting the decision. Those findings will be reviewed and approved before being distributed to the parties involved.
The dispute also affects local food waste processing. Spoil to Soil partnered with Momentum Recycling and the Park City Community Foundation in April 2025 to expand food waste collection and local composting. As the permitting dispute continued, the foundation developed a backup plan to transport collected food waste to Wasatch Resource Recovery in the Salt Lake Valley.
The council’s decision comes as Summit County works to expand composting and recycling through its newly adopted Save Our Space: Plan 2063, which aims to extend the life of Three Mile Canyon Landfill by a decade.
Wednesday’s vote resolves the county-level appeal. The meeting did not establish whether Mimbach intends to submit a new permit application or pursue further legal action.
