Ohioans are months – or less – away from being able to purchase marijuana from a state-licensed dispensary after voters approved sales in the November 2023 election.
Under the voter-approved law, only currently operating medical marijuana businesses will be allowed to sell to recreational customers for the first two years. Medical marijuana businesses could begin applying for a recreational license June 7. The Ohio Division of Cannabis Control hasn’t given a timeline for granting licenses to recreational dispensaries; the state has until Sept. 7 to evaluate dispensaries’ plans to comply with state laws and regulations and award licenses.

Ohio has granted 136 medical marijuana dispensary licenses since 2017. Of those, 126 hold certificates of operation that allow them to sell to registered patients. In addition to those sites, existing medical marijuana cultivators can apply for up to three new dispensary locations.

Recreational dispensaries will be able to sell to adults age 21 and older. Adults 21 and older can possess up to 2.5 ounces of cannabis and 15 grams of extracts or edibles. Initially, dispensaries will sell the same types of products sold to medical patients; higher potency cannabis concentrates and combustibles such as pre-rolls are expected later this year, if legislators don’t change the law approved by voters.
Recreational dispensaries can only sell plant material and products from cultivators and processors with a recreational license, according to the Division of Cannabis Control.
Recreational dispensaries are required to set aside products to serve medical program patients, who won’t pay the 10% excise tax on marijuana.
